§ 24.03. Determinations not subject to review.

  • The following determinations are not reviewable under this chapter:

    (1)

    A legislative enactment. A legislative enactment is an ordinance, resolution or adopted motion of the County Board.

    (2)

    Any action subject to administrative or judicial review procedures under State Statutes or other provisions of this Code.

    (3)

    The denial of a tort or contract claim for money required to be filed with the County, pursuant to statutory filing procedures.

    (4)

    Judgments and orders of a court.

    (5)

    Determinations made during municipal labor negotiations.

    (6)

    Determinations subject to grievance, arbitration or other procedures provided in collective bargaining agreements.

    (7)

    Any action or determination which does not involve the constitutionally protected right of a specific person to due process in connection with the action or determination.

    (8)

    The suspension, removal, disciplining or nonrenewal of a contract of a County employee or officer, including complaints filed under § 24.14 by current or past employees of the County alleging a violation of the Americans with Disabilities Act arising from employment in accordance with § 24.14(2)(c).

    (9)

    Any action subject to fundamentally similar review procedures under another ordinance.
